DISTRIBUTION RIGHTS

This policy outlines the rules and guidelines for the distribution, resale, and pricing of the SMGB course, ensuring fairness, integrity, and compliance with the Terms and Conditions.

1. PROHIBETED PRACTICES

  • Affiliates may not:

    • Advertise the course at a price that misrepresents or deliberately undermines its value (e.g., “free” offers or fake discounts).

    • Use misleading claims, false earnings promises, or deceptive tactics to generate clicks or sales.

    • Offer unauthorised giveaways, rebates, or “cash back” incentives.

    • Upload SMGB content (videos, PDFs, templates) to unauthorised hosting platforms.

    • Present themselves as the owner or creator of SMGB.

    • Promote through auction sites (eBay, Gumtree, etc.) or other platforms that diminish brand integrity.

    Violations may result in:

    • Termination of affiliate status.

    • Forfeiture of unpaid commissions.

    • Legal action for damages or copyright infringement.

2. MINIMUM ADVERTISING POLICY (MAP)

  • The official selling price of the SMGB course is £390, or any temporary promotional price set by SMGB Business LLC.

  • Affiliates must not publicly advertise SMGB below the official price.

  • Misleading “flash sales” or unapproved pricing tactics are prohibited.

  • Private conversations with potential customers may include discussion of official discounts released by SMGB, but affiliates may not create their own discounts.

GOOD FAITH JUDGEMENT

Affiliates are expected to:

  • Maintain the integrity of the SMGB brand in all promotions.

  • Avoid exaggerated or false claims.

  • Clearly state that they are an affiliate, not the course creator.

Examples of violations:

  • Deliberately underpricing or promoting “unofficial” discounts.

  • False advertising about earnings potential.

  • Misrepresenting the product as their own.

4. TERMINATION OF AFFILIATE STATUS

Affiliate access may be revoked if an affiliate engages in:

  • Misrepresentation of the course.

  • Unethical or misleading marketing.

  • Copyright infringement or unauthorised use of materials.

  • Activities that damage the SMGB brand or reputation.

Immediate termination may occur in cases of fraud, copyright theft, or deliberate market manipulation.

REVOCATION OF RESALES RIGHTS

Programme affiliate access may be reviewed and potentially revoked if a reseller is found to be in clear breach of these terms, specifically engaging in:

  • Misrepresentation of the course.

  • Unethical marketing practices.

  • Intentional brand damage.

  • Intellectual property infringement.

SMGB Business Academy Ltd will provide written notice before any action is taken unless the breach involves fraudulent activity, copyright violations, or deliberate market manipulation, in which case immediate action may be taken.

AUTHORISED AND UNAUTHROISED USE

Permitted Activities:

  • Can be sold.

  • Can sell resale rights or master resale rights.

  • Can add the product into a paid product bundle or package at a higher price.

Prohibited Activities:

  • Cannot add the product to a free or paid membership site.

  • Cannot give the product away for free.

  • Cannot offer the product as a bonus to another product. However, you may offer bonuses to this product when selling.

  • Cannot sell the product on auction sites (eBay, Gumtree, etc.).

  • Cannot use or sell this product in a dime sale event.

  • Cannot modify video content in any way or upload it to unauthorised hosting platforms.

DIGITAL PRODUCT LICENSING AGREEMENT & INTELLECTUAL PROPERTY PROTECTION

7.1 Revocation of Resale Rights

SMGB Business Academy Ltd reserves the right to review and revoke affiliate access if necessary, particularly in cases where a reseller engages in fraudulent activity, misrepresentation, or misuse of branding materials.

7.2 Intellectual Property Protection

  • The SMGB course, including its videos and content, is protected by copyright law.

  • Any unauthorised modifications, redistribution, or sharing of the course constitutes copyright infringementand may result in legal action.

  • Resellers agree to these terms upon purchasing resale rights and are bound by the Digital Product Licensing Agreement.

7.3 Digital Product Licensing Agreement

All resellers are required to accept the Digital Product Licensing Agreement at the time of purchase. This agreement ensures that:

  • The course’s intellectual property rights are respected.

  • Resellers adhere to brand representation guidelines.

PRIVACY & GDPR COMPLIANCE

In accordance with GDPR, any personal information collected from resellers (e.g., name, email, or payment details) is handled securely and used solely for contractual and legal purposes. For more information, refer to our Privacy Policy.
